MakeYourGuess is a platform and service operated by TwoGoods Haus Pte Ltd, a company based in Singapore (referred to as “MakeYourGuess”, “we”, “our” or “us”).
We provide technology, design, customisation and related services that enable businesses and organisations to conduct interactive promotional activations.
By accessing or using our website or platform, you agree to comply with these Terms & Conditions to the extent applicable to your use.
Customers purchasing our services may also be subject to separate quotations, proposals, service agreements or written terms. Where such an agreement expressly conflicts with these Terms, the agreed contractual terms will take precedence for the relevant services.
If you do not agree with these Terms, please discontinue use of our website and services.
MakeYourGuess provides interactive promotional activation technology and related customisation services for business customers.
Our services may include branded activation pages, participant entry forms, digital experiences, technical configuration and associated support, depending on the agreed scope.
Important: Unless expressly agreed otherwise in writing, MakeYourGuess is a technology and service provider, not the organiser, promoter, judge or administrator of individual customer promotions.
Each customer organising a promotion through MakeYourGuess is responsible for the operation and administration of that promotion, including:
Customers must ensure that the information and materials they provide to MakeYourGuess are accurate, lawful and appropriately authorised for use.
Participation in an individual promotion is subject to the eligibility criteria established by the customer organising that promotion.
Promotions may be restricted to adults aged 18 years or older, and may impose additional requirements relating to location, employment, professional email addresses or other qualifying conditions.
Where a promotion specifies a minimum age of 18, persons under 18 must not participate or receive prizes.
Participants are responsible for providing accurate information and complying with the applicable promotion rules.
Unless expressly agreed otherwise in writing, the customer organising a promotion is solely responsible for determining winners, verifying eligibility, awarding prizes and fulfilling all rewards or incentives.
MakeYourGuess does not independently guarantee the availability, quality, delivery or fulfilment of prizes offered by customers.
Any questions, claims or disputes concerning winner selection, prize eligibility, prize delivery or unfulfilled rewards should be directed to the customer organising the relevant promotion.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
Individual promotions may have separate rules governing entry methods, eligibility, deadlines, selection criteria, tie-breaking procedures, prize conditions and other requirements.
These promotion-specific rules are established by the organising customer and should be made available to participants through the relevant activation page or other appropriate communication.
In matters concerning participation and prize allocation, the promotion-specific rules apply, subject to applicable law.

Depending on the services and arrangements involved, MakeYourGuess and its customers may have different responsibilities for personal information submitted through promotional activations.
Customers are responsible for ensuring that their intended collection and use of participant information complies with applicable privacy and data protection laws, including any requirements concerning notices, consent, marketing communications and retention.
Where MakeYourGuess processes personal information on behalf of a customer, the respective responsibilities may also be governed by a separate data processing agreement or other written instructions.

Customers retain ownership of their pre-existing trademarks, logos, brand assets and other materials supplied for use in their activations.
Customers grant MakeYourGuess the permissions reasonably necessary to use such materials for the provision of agreed services.
No ownership or intellectual property rights are transferred except where expressly agreed in writing.
Pricing for MakeYourGuess services may vary depending on the activation requirements, branding, customisation, campaign duration and additional services requested.
Applicable fees, payment schedules, deliverables, revision allowances, cancellation terms and other commercial conditions will be specified in the relevant quotation, invoice, proposal or service agreement.
Unless otherwise agreed, requests for changes after project approval may result in additional fees or revised delivery timelines.

We aim to provide reliable and functional services but do not guarantee that the website or platform will be continuously available, error-free or compatible with every device, browser or network.
Service availability may be affected by maintenance, internet connectivity, third-party providers, security incidents or other circumstances beyond our reasonable control.
We will use reasonable efforts to address technical issues within the scope of our agreed services.
To the maximum extent permitted by applicable law, MakeYourGuess is not responsible for the acts or omissions of customers in administering their promotions, including decisions regarding participant eligibility, winner selection, prize availability or prize fulfilment.
To the maximum extent permitted by applicable law, we exclude liability for indirect or consequential losses arising from the use of our website or services, except where such liability cannot lawfully be excluded.
Nothing in these Terms excludes or restricts liability for fraud, or any other liability that cannot legally be excluded or restricted.
Any additional limitations or agreed liability caps applicable to paid customer services may be set out in the relevant service agreement.
To the extent permitted by applicable law, business customers agree to indemnify MakeYourGuess against third-party claims, losses and reasonable expenses arising from the customer's unlawful promotion administration, unauthorised materials, failure to fulfil advertised prizes or breach of its contractual obligations, except to the extent caused by MakeYourGuess's own acts or omissions.
We may update these Terms & Conditions to reflect changes in our services, operational practices or legal requirements.
The revised version will be published on this page with an updated revision date. Material changes affecting existing paid customer agreements will be handled in accordance with those agreements and applicable law.
These Terms & Conditions are governed by the laws of Singapore, subject to any mandatory laws that apply to particular users or transactions.
Subject to applicable law and any separate written agreement, disputes arising in connection with these Terms will be subject to the jurisdiction of the courts of Singapore.
